Abstract

Since Chile signed the Convention on the Rights of the Child 34 years ago, the country has advanced in the implementation of international standards of human rights protection in public policies for children, especially in the regulations governing children under state guardianship. In 2021, the National Service for the Specialized Protection of Children and Adolescents, known as Mejor Niñez, was implemented with the aim of protecting children whose rights have been seriously violated, representing an advance over the previous model administered by SENAME. This article analyzes the tensions in the adaptation of this new mechanism to the human rights approach, exploring an alternative proposal that interprets childhood from Whitehead's processual philosophy, enriched with Afroindigenist perspectives and the theory of affects.
